Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Site or place an order. By using the Site, you represent that you meet these requirements and that the information you provide is accurate.

Products, pricing & availability

We work hard to display each product accurately, but we can't guarantee that your screen will show colors and textures exactly as the finished piece. Each garment is hand-finished, so small variations are part of the work, not defects.

All prices are listed in US dollars and may change without notice. We reserve the right to correct errors, inaccuracies, or omissions, and to change or cancel an order if information on the Site is inaccurate — even after you've placed it. We also reserve the right to limit or refuse orders for any reason, including suspected fraud or violation of these Terms.

Custom pieces

Custom pieces are made-to-order. They are subject to the cancellation tiers outlined on our Service page. Once delivered, custom pieces are final sale and cannot be returned, exchanged, or refunded except where required by law. Please review your custom order carefully before submitting. If something looks wrong on your confirmation, email us within 24 hours and we'll do what we can to fix it before we cut.

Payment

We accept the payment methods listed at checkout. By submitting an order, you authorize us (or our payment processor) to charge your selected payment method for the order total, including taxes and shipping. If your payment can't be processed, we may cancel your order. We do not store full payment card details on our servers; those are handled by our payment processor.

Shipping & returns

Shipping, return, and exchange policies are described on our Service page and are incorporated into these Terms by reference. In short: free shipping over $100, $8 flat otherwise; 14 days to return unworn stock items with tags; custom pieces are final sale.

Intellectual property

The Site and its contents — including text, images, photography, films, logos, garment designs, and code — are owned by Lost in Black Custom Co. or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works from any of this content without our prior written permission, except for personal, non-commercial use.

Your submissions

If you submit content to us — reviews, photos, messages, or feedback — you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display that content in connection with our business. You represent that you have the right to grant this license and that your submissions don't infringe anyone else's rights or applicable law.

Prohibited uses

You agree not to use the Site to:

— Violate any law or regulation, or anyone's rights.
— Transmit malware, viruses, or harmful code.
— Attempt to gain unauthorized access to any part of the Site or its underlying systems.
— Scrape, crawl, or harvest data from the Site without our written permission.
— Interfere with or disrupt the operation of the Site or the experience of other users.
— Use the Site to send unsolicited commercial messages.

Disclaimer

The Site and its services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Site will be uninterrupted, error-free, or free of harmful components.

Limitation of liability

To the maximum extent permitted by law, Lost in Black Custom Co. will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or its services. Our total liability for any claim arising out of these Terms or the services is limited to the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or one hundred US dollars ($100), whichever is greater.

Some jurisdictions don't allow the exclusion of certain warranties or the limitation of liability for certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

Indemnification

You agree to defend, indemnify, and hold harmless Lost in Black Custom Co., its officers, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any third party's rights.

Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law principles. Any dispute arising out of or related to these Terms or the services will be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of those courts.

Changes to these Terms

We may update these Terms from time to time. When we do, we'll post the revised Terms on this page and update the "Last updated" date above. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
